At present, these items are under government protection.

In such a situation, people have a question in their mind that who will claim the several tolas of gold and other items recovered from the site of the plane crash? Will the government keep this item with itself? Can this gold and other items be claimed? If yes, then how? Let's find out...

The government protects the property

The government is responsible for the safety of the goods recovered from an aircraft or any accident, the rules for which are very clear. The goods recovered from the place of the plane crash are first taken into custody by the local police and administration, so that they can be secured. After this, these goods are deposited in the government treasury and these goods remain deposited in the government treasury until the investigation is completed.

What are the legal rules?

The rules regarding the ownership of the items recovered from the debris after a plane crash are very clear. The Civil Aviation Ministry and the local administration together identify the real owner of the items. For this, the process of documentary verification is adopted. If any receipt or other documents are available for the jewellery and other items, then identification becomes easy. As far as the Air India plane crash is concerned, the identification of the bodies is still going on. In such a situation, the items recovered from the debris will be identified only after their identification is complete.

You can claim

If someone from your family is a victim of an accident and had valuables with him, then the family of the deceased and his closest relative can claim them. During this, relevant documents, proof of relationship with the deceased, travel documents and other legal proofs will also have to be presented. If everything is found to be correct, then the goods are handed over to the closest relative.

What if no claimant is found?

If there is no claimant for the items recovered from the debris, the government seizes them as government property. However, since this was an international flight, the rules of the Montreal Convention 1999 may also apply, in which it will be decided only after the foreign nationals are identified who is the real owner of the items and who is not.
