Under the Hindu Marriage Act, courts do not automatically divide all property. Property that belongs solely to the husband—such as property acquired before marriage, inherited or ancestral property, or property acquired by the husband that is not jointly owned—does not automatically pass to the wife.

A wife has full rights to her property, including property in her name and jewelry, gifts, cash, and other items received during the marriage. If a property was jointly owned or purchased with contributions from both spouses during the marriage, the court may consider a fair division based on proof of contribution.
