Delhi High Court lawyer Prem Joshi explained that under certain circumstances, a tenant can claim ownership of land they have lived on for several years. On private land, a tenant can claim ownership after 12 years under adverse possession. Adverse possession occurs when a tenant is living there but not paying rent, or if the landlord is not demanding rent. Or if the actual landlord is unknown, a claim can be made after 12 years.

Why can't a tenant become an owner?

According to the law, when a tenant enters into a "rent agreement" with a landlord, they occupy the premises "with the landlord's consent." Adverse possession cannot be proven unless there is a financial transaction or contractual relationship between the landlord and tenant. According to several Supreme Court decisions, once a person moves into a house as a tenant, their status remains that of a "tenant," no matter how long they live there.

What precautions should owners take?
