Kuldeep Singh Sengar, convicted in the Unnao rape case, has received a major setback from the Supreme Court. The Supreme Court has stayed the Delhi HC's decision until the next hearing. The Supreme Court has also issued a notice to Sengar, seeking his response. A bench comprising Chief Justice Surya Kant, Justice J.K. Maheshwari, and Justice Augustine George Masih heard the case. The hearing is scheduled for four weeks later.
It should be noted that the High Court granted bail to Kuldeep Singh Sengar, the former BJP MLA accused in the Unnao rape case. The court also suspended Sengar's sentence pending his appeal. The trial court had sentenced Sengar to life imprisonment in this case. Protests erupted against the High Court's decision, which subsequently led to the Supreme Court appeal. Solicitor General Tushar Mehta presented arguments on behalf of the CBI.
During the Supreme Court hearing, the CBI, seeking the cancellation of Kuldeep Singh Sengar's bail, stated that the victim was underage at the time of the incident. The facts and evidence proved his guilt. This is a case of rape of a minor victim. This is a serious crime and should not be granted bail. Sengar is also guilty of murdering the victim's father.
The lawyer representing the victim in the Unnao rape case stated that the Supreme Court has ordered that the perpetrator will not be released from jail in any case. It has also stayed the Delhi High Court's decision. The other side has been given time to file a counter-affidavit.
The lawyer also said that the victim's family is still receiving threats and their land is being usurped.

Hemant Kumar Maurya, a lawyer representing one of the victims, said, "I want to thank the Supreme Court today. The victim also wants to express her gratitude. The Supreme Court has issued a strict order stating that the accused will not be released from jail under any circumstances, and the relief order has been stayed. The opposition has been given time to file a counter-affidavit, and until then, he will not be released from jail under any circumstances. This is the Supreme Court's order, and the High Court's order is stayed."

The lawyer added, "The victim's family fears that if the accused is released, his gang will kill the rest of the family. I am the victim's uncle's lawyer. He is being pressured into financial ruin. A minor child in his family has been expelled from school and is now unable to get admission in any other school..."
The victim's lawyer, Mahmood Pracha, said, "The victim's family was asking me every day if they would survive the next five minutes. Now, I can at least tell the family that while this isn't a victory, they have been given a small chance to breathe. The CBI's stance reflects what they feared. They took a stand on very limited points. They neither consulted us nor made us a party. They also tried to prevent us from receiving a copy of their petition."
