The Chhattisgarh High Court has acquitted a husband in a case of unnatural sexual relations with his wife. The court said that sexual relations with an adult wife without consent would not be considered rape. Let's know what the whole matter was...

The Chhattisgarh High Court made an important comment in a case of sexual relations with the wife. The court said that a husband cannot be accused of rape or unnatural sex for having sexual relations with an adult wife with or without her consent. The wife's consent is not necessary for having sexual relations or unnatural relations.

According to a report, in its verdict delivered on Monday, the court dismissed the charges against a man. Along with this, the accused was acquitted under sections 376, 377 and 304 of the IPC and ordered his immediate release from jail.

The High Court said- If the age of the wife is not less than 15 years, then any sexual act done by the husband with his wife cannot be called rape under such circumstances. In such a situation, the consent of the wife is not necessary for unnatural sexual intercourse. Therefore, a case under Sections 376 and 377 of the IPC does not stand against the appellant.

The woman died while having sex.

In India, there is no punishment for marital rape. Now, a decision of the High Court has also excluded unnatural relationships from the scope of punishment. The accused of unnatural sex and unintentional murder was convicted by the trial court, but the High Court acquitted him. It is alleged that on 11 December 2017, a 40-year-old man had an unnatural relationship with his wife against her will. After this, the woman had to be admitted to the hospital for treatment. The woman died during treatment.

The trial court had sentenced him to 10 years imprisonment

Then the doctors had said that the cause of the woman's death was unnatural sex. Now the court has accepted that if the wife is not under 15 years of age, then the sexual act done with her is not rape. Any unnatural sexual intercourse cannot be considered a crime. Now the High Court has acquitted the husband of all charges in this case. Earlier, the trial court had sentenced him to 10 years of imprisonment.
