A 25-year-old mentally challenged woman was raped and the accused Hanumanth Magundappa was arrested soon after the incident. The challenge before the police was that the victim could not give her statement due to mental instability. In such a situation, the police took the help of forensic experts.

This was a case of rape of a 25-year-old mentally challenged woman, in which the accused was in police custody. He was arrested immediately after the incident, but the police faced the challenge of getting the accused punished severely. Since the victim was mentally challenged, the police were confused as to how the court would consider her statement. In such a situation, the police took the help of a top forensic expert and they got the culprit punished for his crime.

The date was 17 May 2019, afternoon and the place was a small village in Bagalkot district of Karnataka. A temple fair was going on in the village and there was a festive atmosphere everywhere. The family of a mentally challenged woman living in the same village had also gone to see the fair and she was alone at home. When her elder brother returned from the fair at 4 in the evening, he was stunned to see her condition.

Rape and bite marks all over the body

The 25-year-old woman was raped and had bite marks all over her body. According to the Indian Express report, the family never left her alone but that day, the family members had gone to the fair thinking they would return within an hour. That is exactly what happened and the woman's elder brother returned home early, but by then the worst had happened to him.

The police were informed about the matter and the woman was immediately admitted to the Government Hospital in Bagalkot. The victim was in a state of shock and was in no condition to talk to anyone. The police realized that they would not be able to get any clue from the victim. Meanwhile, the police officers reached the woman's house and during the investigation, it was found that the victim's mobile phone was missing.

The accused was caught from his mobile location

The news had spread throughout the village and there was an uproar over the rape of the woman. When the police checked the location of the victim's mobile phone, it was found that it was still active in the same village. Now the officials started searching the entire village and soon found out that the victim's mobile was being used by 26-year-old Hanumanth Magundappa.

Hanumant worked as a driver. The police immediately arrested him. During interrogation, it was revealed that Hanumant had raped the woman assuming that she would not tell anyone and her family would not dare to complain. Thinking the same, he also stole the victim's mobile. After the arrest, the police started preparing a charge sheet against him.

The case was weak without the victim's statement

The accused was in police custody but there were many challenges in getting him punished. The victim was a mentally deranged woman and the police were confused about her statement in court. The police wanted to put up a strong case against the accused in court. Here, Professor Ashit Acharya, head of the forensic department at SDM College of Dental Sciences, Dharwad, came as a hope for the police.

Ashish Acharya had earlier helped the police in several legal matters. Ashish Acharya also played an important role in providing forensic reports of teeth in the 2012 Nirbhaya gang rape case. The police contacted Ashish Acharya and he not only agreed to help but also to give a statement in front of the court.

Professor Acharya got justice for the victim

Professor Acharya prepared the forensic report of the bite marks on the victim's body and the accused's teeth. In his statement before the court, Professor Acharya said that after taking photographs of the bite marks, it was analyzed with the arrangement of the accused's teeth. He believes that the bite marks on the victim's body and the rotation of the accused person's teeth match.

On 21 July 2023, the Bagalkot court sentenced Hanumanth to rigorous life imprisonment. In its verdict, the court said that considering the facts of the case and the heinous act committed by the accused, he cannot be treated leniently. The accused should be dealt with strictly so that others with similar thinking get a lesson.
