If you stop your wife from studying, you will be in trouble, MP High Court gave its verdict on a 10-year-old divorce case

The High Court in Indore, Madhya Pradesh has tried to set the parameters of what will be considered cruelty in the relationship between husband and wife. While giving the verdict in the divorce case, the court of Justice Vivek Rusia and Justice Gajendra Singh have put forcing the wife to give up her studies in the category of mental cruelty.
Also, considering it as a ground for divorce, the court approved the divorce. The court said - Forcing the wife to leave her studies or creating such an environment that she cannot continue her studies is equivalent to destroying her dreams at the very beginning of married life. Forcing her to live with a person who is neither educated nor keen to improve himself is definitely mental cruelty and is a ground for divorce. At the same time, a day earlier, the Indore High Court had overturned the decision of the Family Court in a divorce case.
Bhuri, who lives in Shajapur district, was married to a man named Bhim on 1 May 2015. She had passed 12th at that time and wanted to study further. Her in-laws had agreed at that time. One year later, on 16 July, the gauna took place, when it was said that she would be sent back to her maternal home in two days. After reaching her in-laws' house, her in-laws stopped her from studying. Instead of sending her back, they started harassing her for giving one lakh rupees less in dowry and not giving a motorcycle. With police intervention, Bhuri's father brought her home on 27 July. She filed a divorce petition in the Shajapur court. The husband filed a petition for restoration of marriage. The court rejected it saying that it has not been proved that the husband was cruel to his wife.

It was also not proved that the husband had unnatural relations with the wife. The wife herself does not want to live with him and has filed a case on false grounds. Bhuri appealed against this in the High Court, in which it came to light that Bhuri completed her graduation after coming to her parents' home. The High Court approved the divorce based on the statement given by the husband in the lower court to look at all the facts and to stop the wife from getting education.
It is difficult to prove mental cruelty
On the questions raised about proving mental cruelty, the court said- Physical cruelty can be proved easily. But it is difficult to prove mental cruelty on the basis of evidence.
