After BJP's victory, many names are being discussed and one of these names is Nupur Sharma. Can Nupur Sharma, who was suspended by the BJP, become the Chief Minister of Delhi without contesting? Let's know what the constitution says about it and what conditions apply to it. According to Article 164 (4) of the Constitution of India, if a party has a majority in a state and the party proposes a name for the Chief Minister of that state, then the Governor can administer the oath to that person as the Chief Minister, whether that person contested the election or not. This means that people like Nupur Sharma can also get a chance to become Chief Minister, even if they did not contest the Delhi assembly elections.

However, in order to become Chief Minister without contesting, there are certain conditions that must be fulfilled. If a person becomes the chief minister without contesting an election, then he has to win a by-election from a seat in the assembly within 6 months. Apart from this, that person can also become a member of the State Legislative Council.

Some prominent leaders who became Chief Ministers without contesting elections

There have been many leaders in India who did not contest elections or took oath as chief minister despite losing. Among them, the most famous name is that of Uttar Pradesh Chief Minister Yogi Adityanath. The BJP made him the Chief Minister before the UP assembly elections in 2017. At that time he was an MP from Gorakhpur and by resigning from the post of MP, he became a member of the Legislative Council and took the oath of office as Chief Minister. Similarly, the Chief Minister of Uttarakhand, Pushkar Singh Dhami, took over the post of Chief Minister even after losing the assembly elections and won the by-elections. Bihar Chief Minister Nitish Kumar is also a member of the Legislative Council.

Is this way open for Nupur Sharma?

Now the question arises whether Nupur Sharma can get any such facility? If the BJP party wins a majority in Delhi and Nupur Sharma is nominated for the Chief Ministership, he can be sworn in. But for this he will have to win a by-election from one seat and possibly make his place in the Legislative Council as well.
