New Delhi: The Supreme Court has finally granted bail to Delhi CM Arvind Kejriwal in the CBI case. Let us tell you that senior advocate Abhishek Manu Singhvi appeared on behalf of Kejriwal, while Additional Solicitor General SV Raju argued on behalf of the CBI. The court pronounced this decision this morning.
What did Kejriwal's lawyer say?
Arvind Kejriwal's (CM Arvind Kejriwal) lawyer Abhishek Manu Singhvi had said - This matter is only related to the CBI case. Kejriwal is not a threat to society. Kejriwal's name is not mentioned in the initial FIR. He was arrested in this case after two years. The court had already ordered the release of the CM in the ED case. This is CBI's insurance arresting. That is, the arrest was made so that Kejriwal could be kept in jail. There was no arrest for two years. In this regard, three orders of the court are in my favor.
On the other hand, the CBI lawyer had opposed Kejriwal's bail.
During the hearing, the CBI had said that Arvind Kejriwal should have gone to the Sessions Court. The Delhi High Court had also said the same thing to Kejriwal in its order. The High Court had allowed Kejriwal to file a bail application in the lower court, but Kejriwal went to the Supreme Court instead of going to the Sessions Court. The Supreme Court questioned the Delhi High Court's decision to ask Kejriwal to go to the lower court without hearing his bail plea. The Supreme Court said that the High Court should have held a detailed hearing on this.
ASG Raju had said - Every common man has to first go to the lower court for bail. CBI argued that Kejriwal's arrest was necessary and said that arrest is an important part of the investigation. Kejriwal was given notice. This was not a sudden decision of the HC.
ASG Raju had said - If the Supreme Court grants bail to Arvind Kejriwal, it will lower the morale of the Delhi High Court. If he gets relief, all the witnesses will turn hostile under pressure.
Earlier, the court had released many accused including Sanjay Singh, Manish Sisodia, K Kavita, Vijay Nair on bail. On the other hand, Delhi High Court had rejected the bail plea of CM Arvind Kejriwal in the month of August this year.
What allegations did the CBI make against Kejriwal?
Actually, Kejriwal wanted to hand over the liquor policy to private hands. For this, the leaders of the South camp met him. Kejriwal himself did not take the bribe money in his account, but his associates took kickbacks. Kejriwal's knowledgeable leader i.e. Kavita asked for the bribe, the bribe money was received, the policy was implemented, the vendors of the South were benefited and this money was also used in the Goa elections. Everything happened under the guidance of Kejriwal.
The main reason behind the CBI's interrogation and arrest of Kejriwal in the Delhi's new liquor policy was that Kejriwal was a part of the cabinet that approved the new liquor policy. Apart from this, statements of many witnesses, witnesses' meetings with Kejriwal, evidence of Kejriwal's hotel stay, money transactions, phone records, bank details and other documents were used as the basis in this case.
The CBI alleged that after taking the alleged illegal bribe, changes were made in the then Excise Policy 2021-22 to provide benefits. The second basis is that the profit margin for liquor wholesalers was increased from five percent to 12 percent. All these arguments were given by the CBI.
