Justice SR Krishna Kumar's bench dismissed the petition while hearing the case. Justice Kumar said: All the primary evidence of inciting suicide is present in the FIR. What else should be seen?

During the hearing, the lawyer appearing on behalf of Nikita Singhania in the High Court said that there is no solid basis in the complaint to incite Atul Subhash to commit suicide. No such basis has come to light on which it can be said that Nikita can be held responsible. Whereas Atul Subhash's brother Vikas Kumar alleged that Nikita had made false allegations against his brother and demanded Rs 3 crore. He had lodged a complaint with the police that in the court, Nikita and her family made fun of Atul and told him to either give money or commit suicide.
