Allahabad High Court granted bail to an accused named Atul Gautam in a rape case on the condition that he marries his Muslim live-in partner who has accused him of rape. While granting bail, the court put a condition that Atul would have to marry under the 'Special Marriage Act' and would have to deposit an amount of Rs 5 lakh for the safety of his live-in partner and their child.
This decision has been given by the bench of Justice Rajesh Singh Chauhan. He gave this decision on the basis that both the woman who filed the case and the accused were ready to live peacefully as husband and wife with the newborn child. The court believed that this case was the result of a minor dispute, when both the parties expressed their desire to live together, the decision was given on the basis of this fact.
Both the parties in this case are adults. Both belong to different religions. They were in a live-in relationship for some time. During this time, they had a daughter (who is 4-5 months old now). Later, the woman filed a case under serious allegations.
According to a report by Live Law, the woman filed an FIR under sections 376, 323, 504 and 506 of the Indian Penal Code, alleging that the accused broke his promise to marry her. Seeking bail in the case, Atul approached the High Court and argued that the FIR was filed due to a petty dispute. He admitted that he was the father of the girl and was willing to marry his live-in partner and maintain the child.
After his words, the woman agreed, but at the same time, she expressed apprehension that the accused might change his statement. In such a situation, the court, while granting bail, also puts some conditions before the accused like within seven days of release, he will have to apply for marriage under the Special Marriage Act, and after marriage, he will have to register it as soon as possible, he will have to make a fixed deposit of five lakh rupees for the care of the child, he will have to submit his passport to the court and he will not go anywhere outside the country without the permission of the court, etc.
Let us tell you that this case was heard by the court last year on 5 December 2024. However, the information about this has come to light now. Talking about the FIR, it was filed in July 2024 and the accused was in custody since September.
