New Delhi. Nainital High Court’s Chief Justice KM Joseph who gave the historic decision of revoking Presidency’s Rule in Uttrakhand is being transferred to Andhra Pradesh. Joseph will take the post of Chief Justice in Hyderabad High court in place of B Bhonsle who is transferred to Madhya Pradesh High Court as a chief justice out there. However, sources in the Law Ministry have declined to comment on the issue.
Justice Joseph took charge of Chief Justice in Nainital High Court in July 2014 and his recent decision on President’s Rule is in limelight. Due to his decision, Harish Rawat has made his way sure for the chair Chief Minister. The judgment stated that the use of Article 356 in the state by the Centre is against the rules prescribed by the Supreme Court.
Judge Joseph has slammed the Center in his decision. Joseph affirmed that President is not a king. Not only President but a justice can be also be in fault but their decisions can be challenged in the court.
