JAIPUR: Rajasthan High Court has given interim stay on the appointment of teachers (Grade III) in the Tribal Sub Plan (TSP) areas on a petition challenging reservation on the ground of birth place.
The division bench of Justice K S Jhaveri and Justice B L Sharma order followed a petition by Naresh Nama challenging the government notification on July 4, 2016 making 100% reservation government jobs in the sub ordinate, ministerial and Grade IV posts to the locals of the tribal sub plan areas.
The petition said the petitioner has been deprived in an illegal, unconstitutional and in an arbitrary manner from participating against 1,201 posts of Teacher Grade III (level-I) advertised for the TSP area for the reason that he is not a bona fide resident of the area.
The tribal sub plan areas are the tribal dominated districts of Dungarpur, Banswara, Pratapgarh, parts of Udaipur and Sirohi. The counsel for the petitioner Vigyan Shan argued that the rationale behind granting of 100% reservation in employment to the bona fide residents of TSP is unconstitutional as there is no provision for reservation based on the place of birth of a person. The court posted the next hearing on October 30.
