Only transgenders are third gender, not gays,lesbians or bisexuals,clarifies Supreme Court

Refusing to modify its order, the Supreme Court said, ”There is no confusion.The judgment had clearly stated that lesbians,gays and bisexual  do not fall under the category of the third gender.Only transgender fall under the category as per the Supreme Court order.”

The Supreme Court today clarified that the term 'third gender' only includes transgenders – and not gays, lesbians or bisexuals – as it upheld the OBC reservation for them.

Dismissing a petition along with a penalty incurred on the hearing, the apex court pulled up the Centre which had demanded a modification in its 2014 verdict.

Refusing to modify its order, the Supreme Court said, "There is no confusion. The judgment had clearly stated that lesbians, gays and bisexuals do not fall under the category of the third gender. Only transgenders fall under the category as per the Supreme Court order."

 

LANDMARK JUDGMENT

 

In 2014, in a landmark judgment, the government was asked by the Supreme Court to have a third gender category in all its forms and extend the benefits of OBC quota to them.

The government claimed there was confusion in the verdict over whether third gender also included gays, lesbians and bisexuals.
